PLEASE ENSURE YOU CAREFULLY READ THESE TERMS OF USE AND OBTAIN ANY PROFESSIONAL ADVICE YOU CONSIDER NECESSARY BEFORE USING THIS SITE OR SUBSCRIBING TO, REGISTERING FOR OR PURCHASING ANY OF OUR OFFERINGS. These Terms of Use include all of the terms and conditions set out on this page, along with any terms incorporated by reference into these Terms of Use (collectively, the "Terms of Use"). 

Defined Terms: For the purposes of these Terms of Use: (1) "Offerings" means any of the products and/or services that may be offered (either on a complimentary basis or for purchase) on our Site, including subscription and membership services, e-courses and programs, and any of our individual or group EFT coaching sessions and workshops; (2) "Practitioner" means any certified EFT practitioner providing services for or on behalf of the Company; (3) "Released Persons" means the Company and any of it's officers, directors, employees, agents (including any Practitioner) and any associates or affiliates of the Company, (4) "Site Content" means any of the information or materials contained on the Site, including stories and testimonials, and (5) "User Activities" means: (i) your access to and/or use of this Site or any Third-Party Site (as hereinafter defined), (ii) your use of or reliance on the Site Content or any Third Party Content (as hereinafter defined), and (iii) your purchase, use of, or reliance on any of our Offerings, including your registration for and/or your attendance at any of our individual or group EFT coaching sessions or workshops. All other capitalized terms will have the meaning given to such terms elsewhere in these Terms of Use. 

Ownership and Access to Site: This Site, any related social media platforms, and all Offerings are owned, operated and/or offered by NPugliese Consulting Inc. (herein referred to as the "Company", "us" "our" or "we").  Access to and use of this Site is intended for individuals aged 18+ years who agree to be bound by the Terms of Use. If you are currently under the age of 18 and/or you do not agree with the Terms of Use, you must immediately stop all User Activities. 

Acceptance of Terms of Use: BY ENGAGING IN ANY OR ALL OF THE USER ACTIVITIES, YOU ACKNOWLEDGE AND AGREE THAT: (1) YOU ARE OF LEGAL AGE (18 YEARS OF AGE OR OLDER) AND COMPETENCE, (2) YOU ARE CREATING A LEGALLY BINDING AGREEMENT BETWEEN YOURSELF AND THE COMPANY, AND (3) YOU HAVE CAREFULLY READ, UNDERSTOOD AND AGREE TO BE FULLY BOUND BY THESE TERMS OF USE. 

No Representations, Warranties or Guarantees: No Site Content or Third-Party Content (as later defined) accessed by you on or through the Site is to be considered a warranty, guarantee or prediction of outcome for any individual using EFT. As each person responds differently to EFT, the results and benefits of using Emotional Freedom Technique will vary from person to person. The Company does not warrant that our Site will be uninterrupted or free from error and we make no representations or guarantees as to the completeness, accuracy, security or fitness for any particular purpose of the Site, Site Content or Offerings or in regards to any results you may or may not obtain from the use of our Site, Site Content and Offerings.

Third-Party Websites and Content: This Site may contain links to other websites that are not owned or operated by the Company (each a "Third-Party Site") or to information, articles, studies and other materials that are written or published by a third party (the "Third-Party Content"). The Company does not endorse or make any representations or guarantees in respect of the accuracy, security, quality, integrity or fitness for any particular purpose of any Third-Party Site or any of the Third-Party Content or in respect of any products or services contained on or offered through any Third-Party Site. In addition, the Company does not accept any responsibility or liability for your use or misuse of any Third-Party Site or Third-Party Content. 

Communication Between Us and You:  When you access our Site, make calendar bookings through our Site or send us texts or email messages, you are communicating with us electronically. We may likewise communicate with you through electronic means (via email, text messages, or by posting information on our Site) and you consent to receiving information from us in this way. You also agree that we may contact you by phone. Except for your personal information, any information that you submit to us electronically via this Site (whether by direct entry, submission or booking, email, or otherwise) or by text messaging will become the sole property of the Company and will be treated as non-confidential and non-proprietary to you. This includes any feedback or suggestions regarding the Site, Site Content or our Offerings.

Intellectual Property: All Site Content and Offerings are protected by applicable copyright laws. You may download information from this Site and print out a hard copy for your personal use only. For greater clarity, you may not sell or re-sell any of our Offerings or copy or imitate the Site Content or the design or style of our Site.   

Updates to Terms of Use: We reserve the right to update these Terms of Use from time to time, without directly notifying you. Updates will be made by posting any changes directly to this page (or, to any applicable page incorporated by reference into these Terms of Use). Please be sure to review our Terms of Use each time you access this Site. Your continued use of the Site after any changes to the Terms of Use have been posted will be considered your acceptance of the revised Terms of Use. 

Miscellaneous: (i) These Terms of Use will be governed by and interpreted in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein, (ii) if any of these Terms of Use are found to be invalid by a court of law, then those portions will be deemed to be severable and will not affect the validity or enforceability of the remaining provisions.

Payment: Full payment for Offerings, including individual and group EFT coaching sessions, series and workshops, is required at the time of booking via the payment options offered at the time of purchase. If you wish to pay by e-transfer instead, please reach out to nicole@enlitenuptapping.com so that alternate arrangements may be made. The Company will have no obligation to provide any Offerings until payment is received. All prices quoted on the Site are in Canadian dollars and do NOT include applicable sales taxes. We reserve the right to change pricing and Offerings at any time. Note: currently, 5% GST will be added to the purchase price of all Offerings at the time of payment. The Company reserves the right to charge you, whether now or in the future, for any and all taxes that Company is required to pay or collect related to your purchase of our Offerings.

All Sales Final: Once purchased, no returns will be permitted and no refunds or partial refunds will be offered or issued in respect of any Offerings. Except as otherwise set out in the "Cancellation and Re-Booking" provision below, substitutions or make-up sessions/series/workshops will not be offered or permitted unless otherwise agreed to by Company, in its sole discretion. 

Cancellation and Re-Booking: (i) Individual EFT Coaching Sessions: No refunds or make-up sessions will be offered or provided for missed or cancelled sessions or for sessions that are rescheduled less than 24 hours prior to the start of the originally scheduled session. For bundled sessions, no refunds or make-up sessions will be given for any missed or cancelled bundled session or for any bundled session that is rescheduled less than 24 hours in advance. For greater clarity, if you would like to reschedule a previously scheduled session, then provided you do so more than 24 hours in advance you will be entitled to re-book such session on another day at no additional cost; (ii) Weekly Group EFT Sessions: No refunds or make-up sessions will be offered or provided for missed or cancelled sessions; and (iii) EFT Group Tapping Series or Workshops:  No refunds or make-up sessions will be offered or provided for any portion of a series or workshop that you miss or are unable to attend.  If you need to cancel your participation in a group tapping series or workshop that you have previously registered for, then provided you notify us not less than 14 days in advance of the start of the originally scheduled series or workshop, you will be permitted to register for any future series or workshop of the same or lesser value at no additional cost. No substitute series/workshops will be offered or provided where notice of cancellation is received less than 14 days prior to the originally scheduled series/workshop.  In the unlikely event that the Company must cancel a series or workshop, you will receive a full refund of the purchase price paid, however the Company will not reimburse you for or be liable in respect of any optional expenses, including but not limited to, flights and accommodation (where applicable).  

Rescheduling by Practitioner: If your Practitioner is required for any reason to reschedule: 

(i) your individual EFT coaching session, you agree to work with the Practitioner to re-schedule such session (at no additional cost to you) at the earliest possible future date; and 

(ii) any weekly group EFT session booked by you, you will be given a credit (for the full value of the originally scheduled session) that may be applied to any future weekly group EFT session.

Failure to Show Up On-Time: To obtain the maximum value from your individual or group EFT coaching session, it is important for you to show up on time. If you are late for a session for any reason, the session time will NOT be extended. 

Confidentiality: By purchasing or enrolling in any group EFT coaching session, series or workshop (collectively, the "Group Sessions"), you are agreeing to keep confidential and not reveal, disclose, post, publish or otherwise disseminate outside of any Group Sessions: (i) the identity of any third-parties participating in such Group Sessions (collectively, the "Participants"), and/or (ii) any content, material, or stories raised or discussed within the Group Sessions, including any information learned, disclosed or obtained in respect of one or more Participants (collectively, the "Confidential Information"). For greater clarity, while you are free to discuss your personal results from participation in any of our Group Sessions, you must keep the experience and statements (oral or otherwise) of the Participants in strict confidence. In addition, you acknowledge and agree that while Participants are required, pursuant to these Terms of Use, to keep all Confidential Information confidential, the Company can not guarantee that Participants will do so. As such, you acknowledge and agree that none of the Released Persons shall be responsible or liable in any way for the action or inaction of the Participants and you hereby release the Released Persons from all claims associated with the disclosure by a particular Participant of any information, including Confidential Information, that you choose to share during any of our Group Sessions.   

Recordings: By purchasing or enrolling in any of our Group Sessions you acknowledge that the host(s) of any such sessions may choose to enable an audio and/or visual recording of the sessions, and you authorize the Company to make and store such recordings for educational purposes, including the distribution of such recordings to Participants. Participants are NOT permitted to make their own recordings (whether audio, visual or both) of any Group Sessions.

Technology Issues: Due to the on-line nature of the Products and Services, a stable internet connection is required. 

(1) If your individual EFT coaching session is delayed, interrupted or must be postponed due to technical issues, you will be: (i) re-booked at a later date for the balance of time that remained in your session as at the time of interruption or postponement at no extra charge, or (ii) if mutually agreed to by you and the Practitioner, the session may be continued by phone; provided that after two or more instances of a session being interrupted, delayed or postponed due to issues with your internet connection, any re-booking of all or a portion of such session will be by audio/phone only. 

(2) No substitutions or make-up sessions, series or workshops will be offered or provided in the event that any of your Group Sessions are interrupted or disrupted in any way due to your internet connection or other technology issues that may occur on your end. 

Written Acknowledgement and Release: Upon confirmation of your booking and prior to your participation in any of our individual or Group Sessions, you may be asked to sign and return a written agreement containing an acknowledgement that you have read, understood and agree to be fully bound by these Terms of Use (as they may be updated from time to time), including the limitation of liability, release and indemnity provisions found below in these Terms of Use. Failure to do so (if requested) in advance of your session, series or workshop may result in the cancellation of same without refund, in the Company's sole discretion. 

Emotional Freedom Technique is not  psychotherapy and in no case is EFT intended to diagnose, treat, cure, or prevent any disease or psychological disorder. 

This Site, the Site Content and all information, materials or techniques provided or presented during or in connection with any of our individual or group EFT coaching sessions or workshops (or otherwise provided in connection with our Offerings) is intended to be educational and informative in nature and is provided as general information only. In no event should any such information, techniques or materials be considered as medical, psychological, nutritional, therapeutic, legal or other professional advice, nor should it be used to diagnose or treat any mental or physical health issue or be used as a substitute for proper care and treatment from a licensed healthcare provider. 

None of the Released Persons are licensed to engage in the practice of medicine. As such, we can not diagnose any illness or prescribe medication or treatment of any kind for you. If you have a mental or physical health condition that has been diagnosed by a licensed medical practitioner or if you are experiencing any physical or mental condition that you believe requires the attention of a licensed healthcare provider: (i) you agree to advise the Company and your Practitioner of this in advance of any individual or group EFT coaching session or workshop, and (ii) you acknowledge and agree that our Offerings should only be used in conjunction with you obtaining that care. If you have a medical emergency, please seek medical attention immediately by calling 911. 

If you are on any medications, you agree NOT to change any dosages or make any changes to such medications without consulting your physician or other licensed medical professional who prescribed the medication. In addition, you should always consult with your physician (or such other trusted, licensed healthcare provider as you consider appropriate) before undergoing any new activity, program or treatment or before changing or stopping any medications or treatments that you have been prescribed or advised to take.     

EFT is a stress reduction technique that works with both the body and the mind to enhance and promote physical, mental, emotional, and spiritual well-being. During our individual and group EFT coaching sessions and workshops, you will be guided to gently tune into your presenting issue (for example, a personal challenge; a stressful or upsetting memory; a limiting thought or belief; or an unwanted or destructive habit or craving) while tapping (using your fingertips) on various targeted pressure/meridian end-points of your body. The primary aim of these sessions is to diffuse the emotional charge (and promote healing around) the physical and/or emotional issues that are standing in the way of you achieving your personal and professional goals.

While there is a large and growing body of scientific research showing the effectiveness of EFT in dealing with a wide variety of issues, this technique is still regarded as experimental in nature. As such, you agree to assume and accept full responsibility for your own well-being both during and after your purchase or participation in any of our Offerings. 

It is not uncommon to experience the following during, or as a result of, an EFT session:

• the intensity of previously vivid or traumatic memories may diminish. While this is generally considered a benefit of EFT, this may adversely impact your ability to provide compelling legal testimony regarding a traumatic incident and should be taken into account in situations where such legal testimony may be required;
• reactions may surface during or after an EFT session that are not anticipated, including the release of strong/old emotions, such as sadness or grief. In addition, you may suddenly remember or gain insight into previously unremembered or unresolved memories of past events or trauma;
• you may experience varying physical sensations, including an increase or decrease in physical pain or discomfort. If you experience any discomfort that you believe is a result of or connected in any way to your individual or group EFT coaching session or participation in any coaching workshop, you should communicate this experience to us as soon as possible; 
• emotional material (including insights, thoughts, memories of past events, or old/ unresolved emotions) may continue to surface after participation in any EFT coaching session or workshop. It is important to make a note of this when/if it occurs so that you can discuss it with your Practitioner at your next session (note: this material may offer clues or insight into other events, incidents or issues that need to be addressed). 

Assumption of Risk and Limitation of Liability: All User Activities are undertaken by you in your sole discretion and at your own risk. None of the Released Persons are liable to you or any third party for any loss or damage (including, without limitation, direct, indirect, special or consequential damages) arising from or in connection with your participation or engagement in any of the User Activities, including but not limited to, your reliance on, or your use or misuse of, any of the Offerings. For greater certainty, this limitation of liability extends to and includes any loss or damage to your computer or other electronic devices and/or systems or data arising from or in connection with you accessing our Site or any Third-Party Site or you downloading or sharing any information or material found on our Site or on any Third-Party Site. Any downloading or sharing of such information or materials is at your sole discretion and risk. 

Release and Indemnity: You hereby agree to release, indemnify and hold harmless the Released Persons from any and all liability, claims, damages, losses, costs and expenses (including legal fees) arising from or in connection with your participation or engagement in any of the User Activities. For greater certainty, unless otherwise prohibited by law, this release and indemnity extends to any incidental or consequential damages incurred as a direct or indirect result of your participation or engagement in any of the User Activities.
